General Terms

  • USI reserves sole discretion to: (1) interpret the terms and conditions of the Program, including the Program job guarantee; (2) decide whether Program eligibility criteria and job search requirements have been met; and (3) decide whether any disqualifying conditions have occurred.

  • USI shall have thirty (30) days following submission of a written request for refund to determine, in its sole discretion, whether the request meets Program requirements (the “Review Period”). Qualifying refund will be provided after the applicable Review Period.

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL USI’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE PROGRAM, THESE TERMS AND CONDITIONS, OR A PARTICIPANT’S ENROLLMENT OR PARTICIPATION IN THE PROGRAM EXCEED THE AMOUNT OF TUITION ACTUALLY PAID BY THE PARTICIPANT FOR THE PROGRAM. USI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST WAGES, LOST EMPLOYMENT OPPORTUNITIES, EMOTIONAL DISTRESS, OR REPUTATIONAL HARM, EVEN IF USI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  • USI shall not be liable for any failure or delay in performing its obligations under the Program, including but not limited to delays in job placement timelines, to the extent such failure or delay is caused by events beyond USI’s reasonable control, including but not limited to acts of God, natural disasters, pandemics, public health emergencies, war, terrorism, labor disputes, government orders, changes in applicable law or regulation, widespread economic downturns, industry-wide hiring freezes, or material disruptions in the labor market.
