WHAT KIND OF PERSONAL INFORMATION DOES USI COLLECT

The privacy and security of your information is important to us. We give you the option of signing up to receive email updates. If you choose to register with us, we require you to give us your name and e-mail address. In addition, the Websites collect contact information in connection with other users whom you will manage with the Websites. We take care to protect the online data you submit to us when using the Websites and store such information in a secure database.

Additionally, some information about your server address, web browser, and computer system are automatically transmitted to our web servers so that we can operate and improve the Websites. For example, we track the number of people who view each page, the order in which pages are viewed, and other information to learn which features are the most popular and to refine our design and marketing efforts. We collect and store such information on an aggregated (collected) basis.

As part of the services offered at the Websites, we reserve the right to collect automatically and track:

  • The home server, IP addresses and domain names, e-mail addresses, type of computer, and type of web browser you are using while you visit the Websites; and
  • Other information volunteered by you when you use the Websites.

 

HOW WE USE YOUR PERSONAL INFORMATION

  • Email Sign-Up: When you provide us with your email address we may use that information to contact you by email to send you updates about new services or e-mailed support requests or about a material change to this Privacy Policy or the Terms and Conditions, or to comply with applicable statutes and regulations or legal process served on USI.
  • Aggregated Uses of Information:
    • We use IP addresses to help diagnose problems with our server and to administer the Websites, to authenticate user accounts, and to gather broad demographic information.
    • We use demographic and profile data only for personalized content and statistical information and do not share those data with other companies except in ways that do not personally identify our users. We use these data to tailor the visitor’s experience at the Websites, showing you content that we think might interest you, and displaying the content according to your preferences.

USI will not share your e-mail address with anyone else, except that USI may disclose information about its users if required to do so by law or in the good-faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. PUBLIC MESSAGE BOARDS AND FORUMS

The Websites may make chat rooms, forums, message boards, or news groups available to its users. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

SECURITY

The security of all personally identifying information associated with our users is of great concern to us. Although perfect security does not exist in any transaction process on line or in stores the Websites have security measures in place to protect the loss, misuse and alteration of the information under our control. Please be assured that we are constantly reviewing our security processes to keep up to date with the absolute highest levels of security encryption and service.

SHOPPING

USI implements a variety of security measures to maintain the safety of your personal information to ensure a safe and secure shopping experience on our site. User personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems. When you place orders or access your personal information, we offer the use of a secure server. All sensitive/credit information supplied by users is transmitted via Secure Socket Layer (SSL) or other standard security encryption technology and then encrypted into USI’s databases to be only accessed as stated above.

COOKIES

A “cookie” is a small file sent from a web server to your browser and is stored on your computer’s hard drive when you visit certain Websites. Cookies help web surfing by saving visitor preferences and other information. The use of cookies is a widespread industry standard and thus many major Websites use cookies.

OPTING-OUT

The Websites provides user the opportunity to opt out of receiving communications from us at the point where we request information about the visitor. At your request, we shall remove all of your information from our database.

REQUESTING TO SEE YOUR PERSONAL INFORMATION

You may request via e-mail, U.S. Mail or telephone that we provide you with the personal information we have concerning you. Once you receive this information, you may request that we modify or remove any of your personal information. We reserve the right to verify your identity before sending you this information.

You may make changes to that personal information by logging into your account and going to the “Edit Profile” page within the “Settings” selection.

The Websites contain links to other sites. USI is not responsible for the privacy practices or the content of such other sites. Occasionally, you may receive cookies from third-party advertisers, partners and vendors. We do not control these cookies.

CALIFORNIA RESIDENTS

Residents of California, thanks to section 1798.83 of the California Civil Code, may request, once per calendar year, from companies conducting business in California a list of all third parties to whom the company has disclosed certain personally identifiable information as defined under California law during the preceding year for third-party direct-marketing purposes. In your request, please attest to your being a California resident and provide a current California address for our response.

If you are a California resident and under the age of 18, and a registered user of this Website, section 22581 of the California Business and Professions Code permits you to request and obtain the removal of content that you have publicly posted. Please note that your request will not ensure a complete removal of the content and that in some cases the statute may not require or allow removal even if requested.

ACCESS TO CHILDREN

We do not direct any features of the Websites to children under the age of 13. Children under 13 may not register with USI, download, install, or use any of the services available on the Websites.

Although USI does not currently direct Websites that it operates to children under the age of 13, any forthcoming Websites that interact with children under the age of 13 will always require parental consent prior to collecting personal information. Such Websites will also provide parents with access to information collected about their child and the opportunity to opt out of future collection and have us delete such information. Without prior parental consent, USI will use a child’s on-line information only to respond directly to the child’s request and will not use it for other purposes without prior parental consent.

USI strongly encourages parents and guardians to supervise their children’s online activities and to consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. These tools also can prevent children from disclosing online their name, address, and other personally identifiable information without parental permission. Products and services for sale are intended for purchase by adults. By making a purchase on the Websites, you agree that you are at least 13 years of age.

USI and Websites that it operates will…

NOT collect personally identifiable off-line contact information from children under the age of 13 without prior parental consent.

NOT distribute to third parties any personally identifiable information with respect to children under the age of 13 without prior parental consent.

NOT give the ability to post publicly or otherwise distribute personally identifiable contact information with respect to children under the age of 13 without prior parental consent.

NOT entice children under the age of 13 by the prospect of a special game, prize or other activity, to divulge more information than is needed to participate in the activity.

LIABILITY AGREEMENT

USI ACKNOWLEDGEMENT OF RISK, HOLD HARMLESS AGREEMENT, RELEASE OF LIABILITIY AND AGREEMENT NOT TO SUE Acknowledgment and acceptance of this Agreement constitutes a contract. The conditions of the contract are set forth below and will prevent your ability to sue USI. If you do not agree with these conditions, then do not participate in this event offered by USI. YOU ARE SOLELY RESPONSIBLE FOR ANY ACCIDENTS THAT MAY OCCUR DURING THE OPERTION OF THE DRONE OR UAV WHILE UNDER YOUR CONTROL. BY SIGNING BELOW, I ACKNOWLEDGE THAT I AGREE TO TAKE ALL RESPONSIBILITY FOR LOSS AND INJURY. IF NO, PLEASE DO NOT PARTICIPATE ANY FURTHER. I understand and am aware that flying unmanned aerial vehicles is an inherently hazardous and dangerous activity. I understand that participating in any of these activities is purely a voluntary activity, one that involves a risk of serious bodily injury and/or death. On behalf of myself, my children, heirs, executors or assigns, I hereby freely and expressly assume and accept responsibility for any and all risks of injury or death while participating in this activity regardless of any negligence on the part of USI, its officers, employees, students, or representatives, or otherwise. USI and the Flight Instructor are in no way responsible for any firmware update completed. This responsibility lies on the owner of the equipment or the manufacturer. IMPORTANT: I hereby understand that USI uses a “You Break It, You Buy It” policy. The USI class is designed to be safe and have students be cautious and controlled. While there have been many documented reasons for crashes it has been determined that the main reason is pilot error. If it is determined that the circumstances leading to any mishap is due to pilot lack of attention, failure to follow instructions, or disregard of safety limitations the student will be required to compensate USI for any and all damaged equipment. If a USI piece of equipment is destroyed, the customer will need to purchase the equipment. I understand that there are inherent and other risks involved in operating a drone and or an unmanned aerial vehicle, including the use of flying objects, spinning propellers and equipment that can fall from the sky, as well as the drones themselves. These risks include, but are not limited to: variations in weather, flying close to lift towers, cables, utility lines, pipes, poles, and guy wires. There is also a risk of collision with such obstacles, equipment and natural objects as well as with other pilots, spectators and passing pedestrians. Flying conditions vary constantly because of weather changes and in particular wind. I am aware that I am responsible for my actions when in command of the drone at any time. Outlined herein are only some of the risks of flying drones. For instance, flight conditions may vary with weather changes. All of these and others risks and conditions present the risk for a serious and/or fatal injury. I acknowledge that USI has no responsibility or control over the conditions at the flight zone. In consideration of my participation in the activities of flight training, I hereby agree to accept full responsibility and assume all risks to my health, of any injury or death that may result from such participation. I agree not to sue USI or any company affiliated with its officers, employees, students, or representatives, or otherwise. I hereby release and discharge USI, its officers, employees, students, volunteers and their assigns, representatives and successors from any liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of actions for loss of or for damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation in the activities of drone flying whether caused by negligence of the company, its trustees, officers, employees, students, or representatives, or otherwise. I further agree to indemnify, defend, and hold harmless USI, its officers, directors, employees, agents, volunteers and assigns from and against liability, losses, damages, claims, causes of action, cost or expenses (including reasonable attorneys’ fees) which directly arise out of my negligence or intentional acts or omissions arising out of or incident to participating in the activities of drone flying and or training. I ACKNOWLEDGE AND REPRESENT THAT I AM OVER THE AGE OF 18 YEARS AND HAVE CAREFULLY READ THIS ACKNOWLEDGEMENT OF RISK, HOLD-HARMLESS AGREEMENT, RELEASE OF LIABILITY AND AGREEMENT NOT TO SUE. I UNDERSTAND AND ACCEPT ALL TERMS, CONDITIONS, AND RISKS STATED HEREIN. I UNDERSTAND IT TO BE A RELEASE OF ALL CLAIMS AND CAUSES OF ACTION FOR MY INJURY OR DEATH OR DAMAGE TO MY PROPERTY THAT OCCURS WHILE PARTICIPATING IN THE ACTIVITIES OF FLYING DRONES OR UNMANNED AERIAL VEHICLES IT OBLIGATES ME TO INDEMNIFY USI AND THE PARTIES NAMED FOR ANY LIABILITY FOR INJURY OR DEATH OF ANY PERSON OR INCLUDING ME AND DAMAGE TO PROPERTY WHICH OCCURS TO ANY PERSON OR MYSELF AS A DIRECT RESULT OF MY NEGLIGENCE OR INTENTIONAL ACTS OR OMMISIONS. I ACKNOWLEDGE THAT THIS AGREEMENT SHALL BE BINDING ON ME, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND ALL MEMBERS OF MY FAMILY.

I hereby consent to be considered a participant in the commercial UAS operation when the USI pilot conducts a demonstration flight. I acknowledge that USI courses are specifically catered to recreational drone users and emergency services personnel. I understand the USI course does not permit me to operate commercially and only a 333 Exemption and a pilot’s license authorizes me to fly commercially. I understand that USI does not advise me to fly my drone without in-person training with a USI flight instructor. I consent that during the USI course I have not been paid to attend and that I am a recreational user.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to change this policy at any time. We ask that you review this privacy policy from time to time to ensure you are familiar with the most current version of it.

ACCEPTANCE OF THIS PRIVACY POLICY

By using the Websites, you agree to the terms as well as any posted changes of this Privacy Policy. By using the Websites, you hereby consent to the collection and use of this information by USI. If you do not so agree, DO NOT use the Websites.
